Buddy terms & conditions

Hi there, Bunnings has developed a generative artificial intelligence (GenAI) Chatbot (Buddy AI Assistant) designed to assist you with navigating the Bunnings Website (New Zealand) and Bunnings App (New Zealand) (Bunnings Website & App). You can use the Buddy AI Assistant to find Bunnings products, access Do-it-Yourself (D.I.Y.) information, check stock availability, and track order status (Permitted Purpose).

The Buddy AI Assistant will be made available on the Bunnings Website & App to all users – both logged-in and guests (Eligible Users).

Any reference to ‘you’ is also a reference to an ‘Eligible User’ and a reference to ‘Bunnings’, ‘we’ or ‘us’ means Bunnings Group Limited (ACN 008 672 179).

By interacting with the Buddy AI Assistant, you agree to the Terms and Conditions (T&Cs) below. These T&Cs explain your and our respective obligations in relation to the Buddy AI Assistant, so please read them carefully. Your interaction with the Buddy AI Assistant is voluntary. You will not receive any fee, reward or incentive for interacting with Buddy AI Assistant, nor will you be reimbursed for any costs or expenses incurred in relation to your use of, or reliance on, the Buddy AI Assistant or any responses generated by it (Output).

While it may seem like a Bunnings team member is responding to your queries, please note that all responses are generated by the Buddy AI Assistant and not by a human.

Use of the Buddy AI Assistant

We grant you a non-exclusive, non-transferable, limited and revocable licence to use the Buddy AI Assistant solely for the Permitted Purpose.

You agree not to:

• allow any other person to access or use the Buddy AI Assistant through your Bunnings account or login credentials;
• copy, modify or attempt to reverse engineer or otherwise gain access to any software component of the Buddy AI Assistant; introduce any virus, worm, defect, Trojan horse or other malware to the Buddy AI Assistant;
• use the Buddy AI Assistant other than for the Permitted Purpose; and
• use the Buddy AI Assistant in any manner that is harmful, misleading, discriminatory, threatening, defamatory, vulgar, or is otherwise illegal.

You are responsible for all prompts, messages and other data that you provide to the Buddy AI Assistant (Input), and you must ensure that your Input does not breach any applicable law or these T&Cs.

Information Collection

Bunnings collects and stores information provided by you during your interactions with the Buddy AI Assistant, including questions you submit and links you access through it.

We ask that you do not submit any personal information, confidential information, sensitive data, work that is protected by copyright, or other information that you do not have the right to disclose. Any personal information collected through the Buddy AI Assistant will be handled in accordance with the Bunnings Privacy Policy.

Your Feedback

You may provide, and we may receive, feedback, suggestions, comments, recommendations or other communications (Feedback) regarding the Buddy AI Assistant, and we may request such Feedback from you (whether directly, or via an agent or contractor of ours. You agree that we are free to use, reproduce, license and exploit the Feedback, including to improve and enhance the Buddy AI Assistant, without any obligation to you. You hereby assign to us all intellectual property rights, if any, in the Feedback.

Data Usage

The data we collect is used to provide you with information related to your queries, help us better understand and meet our customers’ needs, respond to Eligible Users’ Feedback or concerns, and to support, maintain and improve the Buddy AI Assistant.

Eligible User’s Inputs are not used to train large language modules (LLMs), including those that power the Buddy AI Assistant.

Non-Anonymity

The Buddy AI Assistant is available to Eligible Users signed into their Bunnings ID on the Bunnings Website & App. This means the interactions may be identifiable through your Bunnings ID and IP address. If you don’t interact with the Buddy AI Assistant, we won’t retain a record of your Bunnings ID.

Data Retention

Data collected from Eligible Users’ interactions will be encrypted. Data collected from your interactions with the Buddy AI Assistant is retained for up to 180 days from the data of collection, after which it is deleted. Personal information is removed from conversation logs after collection. During the retention period, Bunnings may access and use the retained data for the purposes described in these T&Cs, including analysis, quality assurance and improvement activities, and this includes content you have deleted from your chat history. If you are signed in, you can access your chat history for up to 30 days, unless you choose to delete any part of it.

D.I.Y. Guidance

The D.I.Y. guidance provided by the Buddy AI Assistant is sourced from the Bunnings website and the Bunnings Workshop website and is for general information purposes only. Please verify any information with appropriately qualified professionals, access your own skills, knowledge and experience, follow all relevant safety guidelines, and use appropriate personal protective equipment before undertaking any D.I.Y. activities.

Pricing information provided by the Buddy AI Assistant does not represent an offer or quote. Please refer to the Bunnings website or your local Bunnings warehouse for current and accurate pricing information.

Product Information

Product information provided by the Buddy AI Assistant regarding product suitability, capability, availability, and terms of use may be inaccurate, incomplete or out of date, and does not constitute advice from Bunnings. Please verify any product information through the Bunnings website, your local Bunnings warehouse, or by consulting an appropriately qualified professional.

Disclaimers

You acknowledge and accept the following:

• We provide the Buddy AI Assistant on an “as-is” basis. To the maximum extent permitted by law, we make no guarantee or warranties (express or implied) that the Buddy AI Assistant or any Output will be accurate, complete, current, reliable, available, secure, uninterrupted or fit for any particular purpose.
• The Buddy AI Assistant is an evolving digital tool that is powered by a third-party LLM. The Buddy AI Assistant may generate content that is misleading, inappropriate or potentially offensive, and which may not reflect Bunnings’ views or values.
• The Buddy AI Assistant provides general information only and does not provide financial, taxation, legal or other professional advice. Any Output is general in nature and does not take into account your individual circumstances.
• You should not rely on the Buddy AI Assistant or any Output as your sole source of information or as a replacement for professional advice.
• If the Output includes a link to a third-party website, your access to that link is at your own risk. Links to such third-party websites do not imply a recommendation or endorsement by Bunnings of any content on those sites.

Liability

The Buddy AI Assistant comes with guarantees that cannot be excluded under the Consumer Guarantees Act 1993 (CGA). To the maximum extent permitted by law, Bunnings liability to you is limited to the rights and remedies available under the CGA. Subject to those rights, Bunnings is not liable for any loss arising from your use of, or reliance on, the Buddy AI Assistant or any Output.

Term

These T&Cs will continue in effect until termination in accordance with these T&Cs.

We may terminate these T&Cs, or limit, suspend or revoke your access to the Buddy AI Assistant for any reason at any time and with immediate effect on giving notice to you.

Upon termination of these T&Cs, all licences and rights granted to you under these T&Cs will also terminate, and you must immediately cease access and use of the Buddy AI Assistant, failing which we may revoke or disable your access. The obligations under these T&Cs that are expressed to, or which by their nature are intended to, survive termination of these T&Cs will survive termination and continue in full force and effect.

Other Provisions

We may update these T&Cs from time to time. The current version will be available at the point of access of the Buddy AI Assistant and on the Terms & Conditions page on the Bunnings website. Your continued use of the Buddy AI Assistant after any update constitutes acceptance of the updated T&Cs.

We may modify the Buddy AI Assistant (including its features and functionality) from time to time.

These T&Cs and any dispute arising out of or in connection with these T&Cs are governed by the laws of New Zealand.

The Bunnings Website Terms also apply to your use of and access to the Buddy AI Assistant.
